Terms & Conditions

These conditions apply to the use of this website and to every quotation, order confirmation and delivery made by KOMR, unless a signed supply contract states otherwise. They are written for professional customers.

1. Information on this site

Codes, temperature classes, alumina contents, spans and lead times published here are typical values from our current range. They are technical guidance, not a public offer. Binding values are those written into a signed specification.

2. Quotations

A quotation is valid for the period stated on it, normally fourteen calendar days, because rolled metal, refractory raw material and energy prices move weekly. A quotation covers only the positions listed in it; scaffolding, dismantling of an old lining, civil works and site cranes are quoted separately.

3. Orders and drawings

An order is accepted when we issue a written confirmation with codes, quantities, prices and dates. Where manufacture follows your drawing, you confirm that the drawing is complete, current and free of third-party rights. We check drawings for manufacturability, not for structural correctness, unless the design work is explicitly part of the order.

4. Tolerances and classification

Refractory products are ceramic and are supplied within the dimensional and density tolerances of the applicable ДСТУ or an agreed technical specification. Colour and surface variations within a fired batch are normal. Steel structures are fabricated to the tolerance class stated in the order; where none is stated, the standard class applies.

5. Prices and payment

Prices are net of VAT unless marked otherwise. The standard schedule is an advance of fifty per cent on confirmation and the balance before dispatch; for repeat customers a deferred schedule can be agreed in the contract. Ownership passes on full payment.

6. Delivery, risk and force majeure

Delivery terms are agreed per order (EXW works, or delivery to your site by our transport). Lead times start from confirmation of the drawing and receipt of the advance. Hostilities, air-raid alerts, damage to energy infrastructure, mobilisation of personnel and closure of transport corridors are force majeure events; they suspend the delivery date for their duration and we inform you as soon as we can assess the impact.

7. Acceptance and claims

Check quantity and visible condition on unloading and note any discrepancy on the delivery document. Quantity and visible damage claims are accepted within five working days; hidden defect claims within the warranty period. A claim should include the batch number from the material certificate — without it we cannot trace the production run.

8. Warranty

We warrant that goods correspond to the agreed specification and certificate. We do not warrant the service life of a lining or a structure, because it depends on operating regime, thermal cycling, atmosphere, installation quality and the mortar used. Where installation is carried out under our supervision and to our instruction, the warranty extends to the installation work.

9. Safe use

Refractory products contain crystalline silica; installation, cutting and demolition require dust protection in line with the safety data sheet supplied with each delivery. Equipment and tools must be operated by trained personnel according to the manufacturer's manual. We are not liable for consequences of use that departs from those documents.

10. Intellectual property

Detailing, calculations and shop drawings produced by KOMR remain our property and may be used by you for the operation and maintenance of the delivered goods. The content of this website — texts, illustrations, tables and code — belongs to KOMR; reuse for another commercial site requires our written consent.

11. Liability

Our liability is limited to the value of the goods concerned as invoiced. We are not liable for lost production, downtime or other indirect loss. Limitations do not apply to damage caused intentionally or by gross negligence, or where Ukrainian law forbids limitation.

12. Governing law and disputes

Ukrainian law applies. Disputes are settled by negotiation; failing agreement within thirty days, by the competent commercial court of Zaporizhzhia oblast, unless the contract provides otherwise.
